These Terms of Use (“Terms”) govern your access to and use of https://floorstoday.ca and any pages, features, content, tools, live chat, forms, and other online services where these Terms are posted or linked (collectively, the “Service”).
Please read these Terms carefully. By accessing or using the Service, you agree to be bound by these Terms.
If you do not agree, do not use the Service.
1) Who We Are
The Service is operated by Flooring Today Inc. (“Floors Today,” “we,” “us,” “our”). We provide flooring product and installation services by appointment only in Ontario, Canada.
2) Eligibility and Use of the Service
You may use the Service only if you:
are the age of majority in your jurisdiction; and
have the authority to accept these Terms on your own behalf or for an entity.
3) Changes to These Terms
We may update these Terms from time to time by posting a revised version on the Service and updating the “Last Updated” date. Your continued use of the Service after changes are posted means you accept the updated Terms.
4) Privacy
Your use of the Service is also subject to our Privacy Policy, which explains how we collect, use, and disclose Personal Information. Our Privacy Policy is incorporated by reference into these Terms.
(For example, our Privacy Policy describes our use of cookies and advertising/analytics tools and our handling of privacy breach obligations consistent with Canadian requirements.)
5) Estimates, Appointments, and Contracts
A. Booking forms are not contracts
Forms on our Service are used to:
request or schedule an appointment (in-home or virtual); and/or
opt in to receive newsletters and offers.
Submitting a form does not create a contract for flooring purchase or installation services.
B. Quotes and agreements
We provide quotes/estimates and, where applicable, written agreements typically in person at your location, and we may also provide and/or confirm acceptance digitally (including by email).
C. Ontario consumer contract rights
Certain consumer agreements in Ontario have legal requirements and cancellation rights depending on how/where the contract is formed and delivered (including rules for “internet agreements” and other consumer agreement types). We aim to provide customers with a copy of the agreement in a manner consistent with Ontario consumer protection requirements.
Important: These Terms of Use apply to your website use. Your actual flooring purchase/installation will be governed by your separate written estimate/contract provided to you.
6) Payments and Financing
A. Payments
We do not offer general online checkout for flooring products on the Service. Payments may be taken:
on-site (terminal), and/or
via invoice payment link.
Our payment processing is handled through Elavon (or other providers shown in your invoice/receipt). Third-party payment processors have their own terms and privacy practices.
B. Financing (Flexiti)
We offer third-party financing through Flexiti. If you apply, you submit your information directly to Flexiti, and Flexiti determines eligibility. Floors Today is not responsible for Flexiti’s decisions, services, or privacy practices.
7) Product Information, Images, and Availability
A. Product visuals and colour variation
Product images, room scenes, and renderings on the Service are provided for general reference. Colour and appearance can vary due to lighting, screen settings, and environment. In-home samples are the best reference in your own lighting conditions.
B. Availability
Products displayed on the Service are subject to availability. While we take steps to reserve/confirm product availability prior to final purchase/payment, we do not guarantee availability until confirmed in your quote/ordering process.
8) “All-Inclusive” Pricing — What It Means
When we refer to “all-inclusive” pricing, we mean that (when included in your estimate) it generally covers:
general furniture moving (moving items aside),
old flooring removal,
flooring installation,
cleanup, and
disposal.
Not included unless specifically stated in your written estimate: asbestos or hazardous materials, mold remediation, major subfloor replacement, structural repairs, stairs/railings (if not included), moving heavy/special items (e.g., appliances, pianos, built-ins), water damage remediation, or other exceptional site conditions.
If we discover major underlying issues during inspection (including moisture/humidity/temperature-related concerns), we will inform you and confirm how those issues affect scope, timeline, or pricing.
9) Installation Timing and Acclimation
We aim to begin installation as soon as the next business day, depending on product availability and acclimation requirements.
Typical acclimation timeframes (may vary by product/site conditions):
Luxury Vinyl (LVP/SPC/WPC): 24–48 hours
Laminate: 48 hours
Engineered Hardwood: 48–72 hours
Solid Hardwood: 5–7 days (or longer if required)
10) Customer Responsibilities for Installation
You agree to ensure, as applicable:
safe and clear access to the work area (including parking/elevator booking where required);
pets are secured;
valuables/breakables are removed or protected;
indoor climate is maintained as required for acclimation and installation; and
condo bylaws/requirements (including sound-rating/underlay rules) are provided where applicable.
11) Live Chat, Calls, and Electronic Communications
A. Live chat
We use Tawk.to to provide live chat. Chat transcripts may be stored for customer service and quality purposes.
B. Calls and call tracking
Calls may be recorded or logged in connection with advertising performance and customer service (including via Google Ads call reporting/call tracking). Use of call features may be subject to third-party platform terms.
C. Electronic communications
By communicating with us electronically (email/text/chat), you consent to receive communications electronically (including confirmations, reminders, and service messages). We may not respond to every inquiry.
12) Marketing Messages (CASL)
Where we send commercial electronic messages (e.g., promotional emails/texts), we will do so in a manner intended to comply with Canada’s Anti-Spam Legislation (“CASL”), including consent, identification, and unsubscribe requirements.
Email marketing: You can unsubscribe using the link in our emails.
SMS: You can opt out by replying STOP (message/data rates may apply).
Opting out of marketing does not prevent us from sending service/transactional messages.
13) Intellectual Property
All content on the Service—text, graphics, logos, product sheets, guides, warranty PDFs, design, layout, and other materials (“Content”)—is owned by or licensed to Floors Today and protected by applicable intellectual property laws.
You are granted a limited, revocable, non-transferable license to access and use the Service for your personal, non-commercial use.
Trademarks
“Floors Today®,” “Flooring Today Inc.,” our logos, and related branding are trademarks/trade names of Flooring Today Inc. You may not use them without our permission.
14) Prohibited Uses
You agree not to:
scrape, crawl, or use automated means to extract data/content from the Service;
copy, reproduce, distribute, or create derivative works from the Content except as permitted by law;
interfere with the Service’s security or functionality;
transmit malware or harmful code;
misuse forms, chat, or contact tools (spam/harassment);
misrepresent your identity or submit false information; or
use the Service in violation of applicable law.
15) Third-Party Websites and Services
The Service may link to or embed third-party services (e.g., Google Maps, YouTube, reCAPTCHA, payment links, scheduling tools, and advertising/analytics platforms). We do not control third-party services and are not responsible for their content, privacy practices, security, or availability. Your use of third-party services is at your own risk and subject to their terms.
16) User Submissions
If you send us feedback, suggestions, or other materials (excluding information protected under our Privacy Policy), you agree we may use them to improve our services without compensation to you.
(You told me customers don’t upload content on-site; measurements/photos are taken by employees with permission—this section is intentionally narrow.)
17) Accuracy, Informational Content, and Site Availability
We try to keep the Service accurate and up to date, but Content may contain errors, omissions, or be out of date. The Service may be temporarily unavailable due to maintenance, updates, or technical issues.
Guides, product information, and blog content are provided for general informational purposes and are not a substitute for professional advice tailored to your specific site conditions.
18) Disclaimer of Warranties (Service)
To the fullest extent permitted by applicable law, the Service and Content are provided “as is” and “as available,” without warranties or conditions of any kind (express or implied), including fitness for a particular purpose, availability, accuracy, non-infringement, or that the Service will be uninterrupted or error-free.
Important: Product and installation warranties are governed by your written purchase/installation agreement and manufacturer warranty documents, not solely by website content.
19) Limitation of Liability
To the fullest extent permitted by applicable law, Floors Today will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of (or inability to use) the Service, even if advised of the possibility of such damages.
To the extent liability cannot be excluded, our liability will be limited to the minimum amount permitted by law.
20) Indemnity
You agree to defend, indemnify, and hold harmless Floors Today from claims, damages, liabilities, and expenses arising out of your misuse of the Service, violation of these Terms, or infringement of any rights of another party.
21) Dispute Resolution, Governing Law, and Venue (Ontario)
These Terms are governed by the laws of Ontario and the applicable federal laws of Canada. You and Floors Today agree that any dispute relating to these Terms or your use of the Service will be brought exclusively in the courts located in Toronto, Ontario, and you consent to that jurisdiction and venue.
22) Time Limit to Bring Claims (Important)
You requested a one-year limitation clause. Ontario’s general limitation rules often provide longer timeframes for many claims (commonly two years in many civil matters), and enforceability of shortened limitation periods can depend on the nature of the claim and whether consumer protections apply.
So the safest “hardened” version is:
To the fullest extent permitted by applicable law, any claim or proceeding arising out of or relating to the Service or these Terms must be commenced within one (1) year after the claim arose; otherwise, it is permanently barred.
If any part of this section is not enforceable in your jurisdiction or for your claim type, it will be enforced to the maximum extent permitted, and the remainder will continue in effect.
23) Severability
If any provision of these Terms is found unlawful or unenforceable, the remaining provisions will remain in full force and effect.
24) Entire Agreement
These Terms (and the Privacy Policy incorporated by reference) form the entire agreement between you and Floors Today regarding your use of the Service.
